Terms of Service for AI BOX Video

1. Acceptance of Terms

By accessing AI BOX Video, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the Service.

We reserve the right to modify or update these Terms at any time at our sole discretion. We will provide reasonable notice of any material changes, such as through email or in-app notification. Your continued use of the Service following any changes constitutes your binding acceptance of such modifications.

2. Service Description

AI BOX Video provides AI-powered video generation tools, including but not limited to "Image-to-Video" conversion and template-based stylization. The Service is provided on an "as is" and "as available" basis. You acknowledge that the Service may evolve, change, or be discontinued as technology and AI models advance.

3. Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is greater) to access or use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the full legal capacity to enter into these Terms.

4. User Account and Guest System

To ensure a seamless user experience, AI BOX Video utilizes a Guest System:

• Guest ID: Non-registered users are assigned a unique Guest ID stored locally within the browser or device.
• Email Binding: To secure purchased virtual assets ("Credits") and enable account recovery across devices, users are required to provide a valid Email Address during the payment process.
• Security: You are solely responsible for maintaining the confidentiality of your Guest ID and Email credentials. AI BOX Video shall not be liable for any loss resulting from unauthorized access to your account or local storage.

5. Virtual Credits and Economic System

The Service operates using a virtual currency system ("Credits"):

• Purchases: Credits may be acquired via one-time "Packs" or recurring "Subscription Plans."
• Nature of Credits: Credits are digital assets with no monetary value, are non-transferable, and do not constitute personal property.
• Refund Policy:
  • (a) Unused Credits: You may request a refund for purchased Credit Packs within fourteen (14) days of the purchase date, provided that none of the Credits from that specific pack have been consumed. Once any portion of a Credit Pack is used for AI generation, the entire transaction becomes non-refundable.
  • (b) Service Failures: If a generation task fails due to a verified technical error on our side, the corresponding Credits will be automatically or manually restored to your balance. No cash refunds will be issued for individual generation results.
  • (c) Legal Exceptions: Notwithstanding the above, refunds will be processed where required by mandatory local consumer protection laws (e.g., EU Right of Withdrawal).
  • (d) Subscription Refunds: For future subscription services, refunds for partial billing cycles are not provided unless required by law. You may cancel your subscription at any time to prevent future charges.
• Technical Failures: If a generation task fails due to a verified system error, the Service may automatically credit the spent amount back to your balance at its discretion.

6. User Content and Conduct

• Ownership: You retain all proprietary rights to the input media you upload. You also own the output generated by the AI, subject to your compliance with these Terms and applicable laws.
• Prohibited Content: You are strictly prohibited from generating, uploading, or sharing content that:
  • Is illegal, defamatory, or promotes violence and hatred.
  • Infringes upon third-party intellectual property, privacy, or publicity rights.
  • Contains Child Sexual Abuse Material (CSAM), extreme graphic violence, or non-consensual imagery.
• License Grant: You grant AI BOX Video a limited, worldwide, royalty-free license to host, process, and use your content solely for the purpose of operating, improving, and developing the Service.
• Account Dormancy: Credits associated with a Guest ID are stored locally. Clearing browser data or changing devices without email binding will result in the permanent loss of Credits. AI BOX Video reserves the right to expire Credits in accounts inactive for more than 180 days.

7. AI Generation Disclaimer

• Unpredictability: You acknowledge that AI output is probabilistic and may be unpredictable. We do not guarantee that the generated content will meet your expectations, be accurate, or be error-free.
• No Professional Advice: AI-generated content is for creative and entertainment purposes only and should not be relied upon as factual or professional advice.
• Content Enforcement: We reserve the right to use automated moderation tools to screen for prohibited content. We may terminate your access immediately and without notice if you are found to be using the Service to generate Non-Consensual Sexual Content (NCII), "deepfakes" of real individuals, or content that exploits minors.

8. Limitation of Liability and IP Disclaimer

• Limitation of Liability: To the maximum extent permitted by law, AI BOX Video and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages. Our total aggregate liability is capped at the amount paid by you for the Service during the six (6) months preceding the claim.
• Intellectual Property Disclaimer: While you own the resulting Output, AI BOX Video makes no warranty regarding the copyrightability of AI-generated content under current or future laws. You are solely responsible for the legal status of your creations.

9. Governing Law and Jurisdiction

• 9.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.
• 9.2 Mandatory Arbitration: Any dispute arising out of these Terms shall be resolved through binding, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
• 9.3 Class Action Waiver: YOU AGREE TO BRING CLAIMS AGAINST AI BOX VIDEO ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
• 9.4 Jury Trial Waiver: You hereby waive your constitutional and statutory rights to a trial by jury.

10. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." AI BOX VIDEO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
